    In the preface, André Tunc informs us about the content and intelligence of this thesis: “Takeover bids, by one technique or another, should normally increase in order to ensure the necessary restructuring of the European economy. However, a recent case has shown, in an almost dramatic way, the deficiency of French law in this area. […] Such a situation is serious. ‘There can be no honest market without honest information for the public… The publication of precise and accurate accounts is an essential element for the proper functioning of the stock exchange’: this was recognized in the United States as early as 1933 […] If we want to save French capitalism, we will therefore have to, among other things, continue the effort undertaken in recent years to better inform the public, and grant the Securities and Exchange Commission, without hesitation, the powers it needs to prevent and, if necessary, repress abusive practices.” As has often been said in the United States: the legislator cannot make fools intelligent, but he can at least ensure that intelligent people have the opportunity to behave intelligently.
