    “The subject of hereditatis petitio is extremely difficult because of the suspicions of interpolation that Romantic scholarship has cast upon the sedes materiae (D. 5, 3) of the Digest. Beseber, as the author rightly points out, posits some 222 alterations in the 58 fragments from which this title is composed (p. 6). As an overall assessment, we can say that Denoyez has addressed all possible aspects of the topic and has clearly highlighted the entire complex problem of hereditatis petitio. (…) The author divides his work into two parts, with an original and judicious approach. The first deals with what he calls the controversia de hereditate, which includes hereditatis petitio proper; that is, the cases in which the heir seeks recognition of his title.” The second part comprises the useful cases of hereditatis petitio which, as the author keenly observes, are only such cases in name, since their function is not to determine who has a right to the inheritance (pp. 5-8).
